Terms of Service and Cancellation Policy
Simple STEM Tutoring

1. Agreement to Terms
By scheduling, attending, or paying for any tutoring session with Simple STEM Tutoring (“we”, “us”, “our”), you (“Client”, “Parent”, or “Student”) agree to be bound by these Terms of Service.
If you do not agree, do not book or attend sessions.
2. Services Provided
In-person tutoring in chemistry and mathematics in Brooklyn, NYC.
Tutoring is conducted by a human tutor only (no AI, no automated instruction).
Sessions are typically 60 minutes, unless otherwise agreed in writing.
3. Scheduling & Cancellation
Cancellation by Client: Notice of at least 24 hours before the scheduled start time is required to avoid being charged for the session.
Late cancellation (less than 24 hours): Full session fee applies.
No‑show: Client will be charged 100% of the session fee.
Cancellation by Tutor: If the tutor cancels with less than 24 hours’ notice, Client may reschedule at no cost or receive a full refund for that session.
Weather/Emergencies: If NYC public schools are closed due to weather or emergency, in‑person sessions are automatically canceled and may be rescheduled or credited.
4. Payment Terms
Fees are due before each session, unless a package has been purchased.
Accepted payment methods: [Paypal].
For session packages (4 or 8 sessions), payment in full is required before the first session.
Packages expire [8 months] from purchase date. Unused sessions are non‑refundable but transferable to another student in the same household.
5. No Refund Policy
Single sessions: No refunds for sessions attended or canceled late.
Packages: No refunds for unused sessions except in the case of a documented medical emergency or permanent relocation outside NYC (written request with proof required).
Dissatisfaction after one session: Client may request a credit for future sessions, but no refund.
6. Code of Conduct
Client and Student agree to:
Treat the tutor and property with respect.
Provide a quiet, safe, distraction‑free environment for in‑person tutoring (e.g., library room, home office).
Not record sessions without prior written permission.
Violation may result in immediate termination of services with no refund for prepaid sessions.
7. Tutor Qualifications & Limitations
Tutors are experienced STEM educators but are not licensed psychologists, medical professionals, or school counselors.
Tutoring does not guarantee specific grades, test scores, or admission to any program.
The Company does not provide homework “completion” services – we teach concepts and problem‑solving strategies.
8. Liability Waiver
To the maximum extent permitted by law:
The Company and its tutors are not liable for any indirect, incidental, or consequential damages arising from tutoring services.
In‑person tutoring carries inherent risks (e.g., travel to/from session, COVID‑19 or other illness). Client assumes all risks associated with in‑person meetings.
Our total liability for any claim shall not exceed the amount paid by Client for the session in which the claim arose.
9. Privacy & Data
We do not use AI or automated systems to analyze student data.
We do not sell or share personal information (name, contact info, school, grades) except as required by law or with explicit consent.
Session notes (paper or digital) are kept confidential but may be shared with parents upon request.
10. Termination
By Client: May terminate anytime with written notice. Prepaid sessions after the effective termination date will be refunded on a pro‑rata basis (minus any administrative fee of $[15]).
By Company: May terminate immediately if Client violates Code of Conduct, fails to pay, or acts in a threatening manner. No refund for remaining sessions in such case.
11. Changes to Terms
We may update these Terms. Material changes will be emailed to the address on file at least 14 days in advance. Continued use of services after changes constitutes acceptance.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York.
Any dispute shall first be attempted to be resolved through good‑faith negotiation. If unresolved, the dispute shall be submitted to binding arbitration in Kings County, NY, under the rules of the American Arbitration Association.
Small claims court actions are exempt from arbitration.
